A federal labor law known as the Fair Labor Standards Act (FLSA) establishes the minimum wage and overtime standards applicable to the majority of employees in the United States. The Department of Labor has provided a fact sheet explaining the meaning of an employment relationship and the significance of that determination. If the company controls or has the right to control the individual’s work performance, that individual is generally considered an employee, rather than an independent contractor. When a worker is an independent contractor, the company will have little to no control over how work is performed.
