(Transportation-News.com, August 04, 2014 ) New York, NY -- GM Ignition Switch Recall Lawsuit News: The Oliver Law Group P.C. has learned through GM’s filing with the U.S. Securities and Exchange Commission (SEC) that the company is facing Ignition Switch Recall Lawsuits in state and federal courts across the United States and Canada over the faulty ignition switch in certain recalled vehicles that disabled the engine, stopped the front airbags from deploying, and in some instances, resulted in death when the vehicle crashed.
In June, a panel of U.S. federal judges consolidated federally filed GM Ignition Switch Recall Lawsuits for pretrial proceedings in the U.S. District Court, Southern District of New York. (In Re: General Motors LLC Ignition Switch Litigation, No. 2543, JPML) As of July 15, there were 96 GM Ignition Switch Recall Lawsuits pending in the multidistrict litigation. GM said in its July 24th SEC filing that it had recalled 29 million vehicles and recorded recall-related charges of $2.5 billion in the first six months of June 2014. Of the total number of recalled vehicles, 2.6 million were Chevrolet Cobalt, HHR, Pontiac G5, Pursuit, Solstice, and Saturn ION and Sky which had problems involving ignition switches that could move from the “run” position to the “accessory” or “off” position. This resulted in a vehicle losing power and drivers either crashing or running off the road. In addition to pending litigation in the New York federal court, GM reported in its SEC filing that as of July 23rd, there were:
• 32 GM Ignition Switch Recall Lawsuits alleging injury or death as a result of faulty ignition switches, inadvertent ignition key rotation or air bags failing to deploy. The lawsuits are pending in federal courts in New York, Texas and Indiana
• A shareholder class action lawsuit filed on behalf of purchasers of GM securities from November 17, 2010 through March 10, 2014. A second shareholder lawsuit was filed for breach of fiduciary duty, waste of corporate assets, and unjust enrichment by GM’s directors. Both lawsuits were filed in the U.S. District Court, Eastern District of Michigan.
• 8 GM Ignition Switch Recall Lawsuits filed in various Provincial Courts in Canada and two lawsuits alleging violations of specific California consumer protection laws.
GM also mentioned in its filings that the company is under investigation by the U.S. Attorney’s Office for the Southern District of New York, the U.S. Congress, the SEC, Transport Canada and 45 state attorney generals in connection with the recent vehicle recalls.

The Associated Press reported that GM knew about the faulty ignition switches since 2001 but did not disclose the problem to the public. In July 2005, a 16-year-old Maryland resident died after her 2005 Chevy Cobalt crashed into a tree. An investigation showed the ignition switch turned off the electrical system and the Cobalt’s air bags did not deploy. In December 2005, GM told its dealers to inform Cobalt owners to take excess items off their key chains. GM did not initiate a public recall of the Cobalt and other vehicles with faulty ignition switch problems until nearly eight years later. According to the AP, 13 fatalities and 43 crashes were purportedly connected to the faulty ignition switches.

The Oliver Law Group P.C. filed a GM faulty ignition class action lawsuit on behalf of a Livingston County woman whose 2004 Saturn Ion shut down allegedly due to a faulty ignition switch. The complaint, filed in the U.S. District Court, Eastern District of Michigan in May, noted that in one instance, the engine and electrical system shut down without warning while the vehicle was in the middle of the road. The woman was able to coast the Saturn Ion to the side of the road without injury, and was later able to safely restart the car. According to the lawsuit, the Livingston County woman was unaware of any ignition switch problems prior to purchasing the Saturn Ion in 2013. The class action lawsuit alleges that “Old GM” (referring to General Motors prior to its bankruptcy filing in 2009) and GM (the company incorporated after its emergence from bankruptcy in 2009) knew about the defective ignition switches for years but failed to disclose the problems to the public. In addition to General Motors LLC, the class action lawsuit also names as a defendant, Delphi Automotive PLC, which manufactures ignition switches. The complaint was filed in the U.S. District Court, Eastern District of Michigan (Case No. 2:14-cv-11912).
